Scroggin Family

Many researchers have indicated that Humphrey J. Scroggin was born in Jones Co, GA. This is not possible since Jones Co, GA was not created by an act of the Georgia Legislature until December 10, 1807. Jones County was created from Baldwin County and is situated geographically to the west of Baldwin County, south of Jasper and Putnam County, due east of Monroe County and north of Bibb County. The biography on Humphrey J. Scroggin in the 1890 History of Conway Co, AR indicates that he was born in Oglethorpe Co, GA. This is information is probably accurate as his grandson William Wilson Scroggin was still alive and this time and probably was the provider of the information.  The migration of Humphrey J. Scroggin's family has been well preserved due to the statements made by his wife Julia in behalf of her Pension Application based on his War of 1812 service in Capt. Leonard Worthy's Company of Major William Wooten's Detachment, Georgia Militia.  A transcription of that affidavit will follow.

The migration date of Humphrey J. Scroggin to Mississippi may not be completely accurate. The 1820 Jones Co, GA census record for George Scroggin (who this writer considers the most probable father for Humphrey J. Scroggin) shows a family living in his household that matches exactly the Humphrey J. Scroggin family.  I have also not been able to locate the entire family on the 1820 Lawrence Co, MS census. There is a Humphrey Scroggin enumerated in 1820 Lawrence Co, MS without a family. Therefore it appears probable that Humphrey's family remained in Georgia until he had obtained a suitable land and home in Mississippi.  More research is required in this area.  Julia Scroggin is listed in the membership records as an early member (1813-1846) of New Hope (Caney Creek) Primitive Baptist Church, Jones Co, GA.  That churches records may hold long hidden answers.

There are other known errors in Julia Cheney Scroggin's testimony, possible due to her advanced age.  She lists a sojourn in Jackson Co, AR.  The correct location was Jackson Township in Dallas Co, AR.  She also incorrectly lists Humphrey Scroggin's death to be in the year 1862.  The Pension Office shows the actual date to have been October 10, 1861.

Humphrey Scroggin's signature (above), at age sixty, was copied by this descendant at the National Archives from original documents that he submitted to obtain the bounty land due him from the Congressional Act of 1855.  There is an identical signature on his affidavit for bounty land under the 1850 Act of Congress.

Leonard Worthy in the Regiment of Militia commanded by Major William Wooten in the War with Great Britain declared by the United States on the 18th day of June A.D. 1812 that he substituted in the place of James Satterwhite who was drafted at Monticello, Georgia and was mustered into service on or about the first of September A. D. 1814 and I substituted and continued in actual service in said war for the term of six months and was honorably discharged at Fort Hawking, Georgia about the 1st of March A.D. 1815 and will appear by the muster rolls of said company. He makes this declaration for the purpose of obtaining the Bounty Land to which he may be entitled under the "Act Granting Bounty land to certain officers and soldiers who have been engaged in the Military Service of United States" passed 28th September A.D. 1850. On this 25th day of September AD One Thousand Eight Hundred and Fifty Five, personally appeared before me, a Justice of peace within and for the County and State aforesaid, Humphrey Scroggin, aged about Sixty years, a resident of Dallas County in the State of Arkansas, who being duly sworn according to law, declares that he is the identical Humphrey Scroggin who was a private in the company commissioned by Captain Leonard Worthy of Jasper County, State of Georgia, in the War with Great Britian, declared by the United States on the 18th day of June 1812 for the term of Six months and continued in actual service in said war for fourteen days; that he has heretofore made application for bounty lands under the act of September AD 1850 and received a land warranty No ___ (not remembered) for 80 acres, which he has since legally disposed of, and cannot now return. he makes this declaration for the purpose of obtaining the additional bounty land to which he may be entitled under the act approved the 3rd day of March 1855. State of Arkansas, County of Conway
On the 29th day of June a D 1875 before me clerk of the circuit court virtue? and for the county of Conway in the state aforesaid personally appeared Julia Scroggin, who being by one duly sworn according to law deposed and says that she is the lawful widow of Humphry Scroggin deceased who was late a soldier in the Georgia volunteers of hte War of 1812. That her application for Pension under act of Congress approved Feby 14th 1871 has been on file in the department for several years numbered 8540. That under date of May 11th 1874 she is required by the commissioner of Pensions to furnish proof her marriage re. The applicant now states that she was married to the said Humphrey Scroggin on the 29th day of July (a.D. 1814) Eighteen Hundred and Fourteen in Jones County, state of Georgia. That there is no record proof of her marriage to the said Humphrey Scroggin's because she says the records of Jones County, Georgia were destroyed during the late war and that fact has been certified under official seal of the said county and sent to the pension office by her agent. She says further upon her oath that she was married by one Mr. Hightower a justice of the peace in said county of Jones. That the said Hightower she is informed has been dead a long time, and therefore she is unable to produce his testimony. That she left Jones County Georgia early in 1818, now fifty seven years ago and she has written to that neighborhood in said county where she was married and she is creditably informed that there is no person living there who was a witness to her marriage nor can she find any one now residing there who was living at that time. That when she left Jones County Georgia she removed with her husband and family to Lawrence County state of Mississippi where they resided about nine years and removed to Holmes County Mississippi and resided there until the year 1834, when they removed to Van Buren County Arkansas and she resided in Van Buren County and Conway County eversince, except a short time they resided in Jackson County. The best proof she can make of her marriage to the said Humphrey Scroggin is from general repute and cohabitation during her married life in the state of Ark from 1834 to 1862 (the year which her husband the said Humphrey Scroggin died) being Twenty Eight years - perhaps she may find a witness in this state who knew her, and her husband in Mississippi - if so, she will produce the evidence. In addition to this she will take the testimony of some of her children. There never was to her knowledge any person in this state but one, who was an eye-witness to her marriage - that was Larkin Scroggin a brother to her husband - he has been dead for over twenty years. She is now near Eighty years of age, and all she now states is from memory. She has no date to be governed by - Her family state. Thomas Franklin was born in Holmes County Mississippi in the year 1828. He was living in Franklin County of this state, but has been recently removed to Washington Territory. Humphrey Scroggin her next child was born in Holmes County, Mississippi and when last heard from a short time ago was living in Calhoun county of this state. He was born in the year 1830. Jefferson R. Scroggin was born in Homes County Mississippi in the year 1833 and when last heard from several years ago was residing in Sevier county of this state. Larkin Scroggin her last child was born in Van Buren county of this state in the year 1835. He died in the spring of 1865. She has been unable to give the day or minute on which her children were born except her first child, but she remembers distinctly the year of their birth. Her husband Humphrey Scroggin died in Conway county Arkansas in the year of 1862 and she has remained a widow since the death of her husband Humphrey Scroggin. That she has been endeavoring to complete her claim for a pension eversince the year 1871 and been doing all in her power to procure the class of testimony as required by the Government; but she finds herself utterly unable to prove her marriage, by any better testimony than is here indicated by her statement. She is now very feeble and unable to do anything for herself and is entirely dependent on her children for support many of whom are getting old are poor and have large families of their own to support; and she is now near Eighty years of age. She therefore respectfully petitions the commission of Pensions, to consider the additional testimony sent herewiith and act on her case at once. That she has changed her residence from Van Buren county to Conway county Arkansas and her Post Office address is now at Lewisburgh Conway County Arkansas at which place she desires all her communications may be addressed. Scroggin who being by me duly sworn deposed and says that he is a resident of Conway County state aforesaid and his post office address is at Lewisburgh in said county. That he is now (53) fifty three years of age. That he was present and saw Mrs. Julia Scroggin subscribe and make oath to the annexed and foregoing affidavit that the said applicant Julia is his own mother. That Humphrey Scroggin deceased who was a soldier in the Georgia Volunteer in the War of 1812 was his own Father. That he has Known Julia the applicant all his life, that is to say from his earliest recollection. That he knew his Father the said Humphrey Scroggin from the said affiants earliest recollection up to the date of the death of the said Humphrey Scroggin, lived with them until he grew up to manhood and have resided in the same neighborhood with them ever since and up to the death of the said Humphrey. That his earliest recollection of his parents the said Humphrey and Julia Scroggin was in Lawrence county Mississippi where he was born. That when he was quite small his family moved to Holmes county Mississippi. The family lived in Holmes county perhaps some Eight of Nine years to the best of his recollection and then moved to Van Buren county Arkansas in the year 1834. That he has heard his Father the said Humphrey and his mother Julia (the applicant) speak frequently of their marriage, (it having occurred while my Mother was on a visit to some of her friends in Jones county Georgia). That before the family Bible was destroyed he had frequently saw recorded the marriage of the said Humphrey and Julia (the applicant) and the date of the marriage given in the Bible was the 29th day of July a D 1814. That from his earliest recollection up to the death of the said Humphrey Scroggin (1862) in the year Eighteen hundred and sixty two the said Humphrey and Julia (the applicant) lived and cohabited constantly and continuously together and recognized each other as husband and wife. That during the married life of the said Humphrey deceased and Julia (the applicant) they had born to them the following named children. In his earliest infancy he was taught by his Father the said Humphrey and Julia the applicant to regard john, William and Matilda as his brothers and sister; and he knows of his own personal knowledge that Julina, George, Thomas, Humphrey, Jefferson, and Larkin were born of his mother Julia (the applicant). the said Humphrey Scroggins during all his life (within recollection of the affiant) regarded all the above named children as his own legitimate offspring and he never heard the marriage of his Father - the said Humphrey and Julia (the applicant) questioned by anybody. He does not know of any body now living who was an eye-witness to the marriage of the said Humphrey and Julia (the applicant) and he is well satisfied no such proof is now in existence nor has not been for at least Twenty years. From his personal knowledge and acquaintance with Julia (the applicant) and from his intimate knowledge of the said Humphrey while he was living he believes that all the statements made by the applicant are true. That the said Humphrey Scroggin died in Conway County Arks in the year 1862 and that Julia (the applicant) has remained a widow eversince the death of the said Humphrey Scroggin her husband; and is a widow at this date. That he resides as above stated and has no interest in this matter except so far that the applicant is his Mother and he feels a great interest in her welfare but he has no pecuniary interest whatever in this application nor is he engaged directly or indirectly in the prosecution of the same.
